We will be transparent about how we handle your Personal Information and our privacy practices. 2. We will use your Personal Information to benefit you and enhance your customer experience. 3. We will protect your Personal Information and handle it responsibly.
We also want to be transparent about how you can help manage your privacy and information, so you can make informed decisions.
1. Scope And Application
This policy relates to the customer Personal Information collected by Livingoods Limited, including its websites and mobile applications. Throughout this policy, we may refer to Livingoods Limited as "Livingoods", "we", "us" or "our".
In this policy, we describe what Personal Information we collect; how we use, share and manage it; how you can access, update and/or correct your Personal Information.
Please also refer to any privacy statements available at our locations, websites or mobile applications available to you at the time your Personal Information is collected.
A. What Does This Privacy Policy Include? This policy describes how we handle your Personal Information, specifically, what we collect, and how we collect, use, share, protect and store it.
This policy applies to you when you visit one of our websites, use our app, sign up to be a part of any of our programs, promotions, contests or events, apply for or purchase our products or receive our services.
2. What Type Of Personal Information Do We Collect and How?
We limit the collection of Personal Information to what is reasonably required to fulfill the purposes for which it was collected. We collect Personal Information, as defined below, in a variety of ways, including directly from you, from third parties, through in-store technologies, and when you are interacting with us online or through our mobile applications.

How We Define Personal Information: "Personal Information" is any information that identifies you or could be reasonably associated with you and includes non-Personal Information that we link to Personal Information. We need to collect, use and disclose certain Personal Information about you in order to serve you, provide products and services, and meet our legal obligations.
B. How Do We Collect Personal Information? We collect Personal Information directly from you, from other sources, from technologies used at our locations, and through our websites and mobile applications.
Directly From You: You may provide Personal Information to us in our stores, by mail, by email, over the telephone, through our websites or mobile applications or in any other direct manner. When you voluntarily share information about yourself with us, we collect that information to provide programs, products or services, respond to your inquiry, or for any other purpose disclosed to you at that time.
From Other Sources: We may receive Personal Information from other sources with your consent or if the law requires or permits us to do so. To ensure accuracy of contact information you provide, such as your name, email address and phone number, we may use a service provider to verify, update, complete or supplement your contact information. This helps protect against error and fraud and helps us manage business operations.
If you register for a Livingoods Account, we may retain service providers to verify and, if necessary, update, complete or otherwise supplement your mobile number or other contact information so that you may be contacted without undue delay if we need to verify your account, provide notice required by law, or provide communications you request about our programs, products, services and promotions.
From Technologies Used At Our Locations: We may collect Personal Information through technologies used in our stores, including your image. These can include point-of-sale systems, video surveillance or similar technologies. We use video surveillance for security purposes, to protect against theft, prevent damage to our properties, and prevent fraud. We may use anonymous video analytics to help manage our stores, understand our customer base and improve customer experience.
Through Our Websites And Mobile Applications: We may collect certain information electronically when you interact with our websites, email, mobile applications, social media accounts, online advertising, or through cookies, web beacons, single pixel gifs and other technologies. This information helps us understand actions you take online and allows our websites and applications to work correctly.
We may combine this information with other information collected in-store or online, such as your transaction history and aggregate demographic information, to support customer understanding, website and mobile analytics, and more tailored advertising and marketing communications, subject to your right to withdraw consent.
Examples include using your location or language preference to auto-select features, using purchase history to provide interest-based advertisements, and aggregating Personal Information to identify online and offline purchasing patterns.
The technologies we use include cookies, web beacons, single pixel gifs, analytics engines, and other tools used for personalization, interest-based advertising, customizing content and understanding customer needs and preferences.
We may use Google Analytics, a web analysis service of Google Inc. ("Google"). Google Analytics uses cookies to analyze your use of our websites, create reports about visitor activities for us and provide services associated with website and Internet use. Although this information is collected through your Google ad settings, it is not provided to us in a personally identifiable format.
You may delete or disable certain technologies at any time through your browser. However, if you do so, you may not be able to use some features on our websites or mobile applications.
3. How Do We Use Personal Information?
We use your Personal Information to provide programs, products and services, manage business operations, communicate offers and information we think may interest you, enhance your customer experience and otherwise as permitted or required by law.
A. Providing Programs, Products, And Services: We use your Personal Information to provide quotes, verify identity, determine eligibility, validate contact information, process applications, deliver programs, products and services, create and maintain accounts, process transactions and returns, and fulfill product and service requests, inquiries and purchases.
B. Interest-Based Advertising: With your consent, we may deliver interest-based advertisements to your device by using a cookie or other identifier assigned to your device. We may place customers in general interest and purchase categories to determine and serve relevant advertisements.
We will not use sensitive data for interest-based advertising purposes without your express consent. Examples of non-sensitive data include groceries, cosmetics and household goods. Client advertisers on whose behalf we may serve interest-based advertising will not receive Personal Information about customers.
You can activate and control tailored advertising in your Livingoods Account or by contacting us directly. If you opt out of tailored marketing, you may still receive advertising based on registration information and agreement to receive Livingoods e-communications.
C. Managing Our Businesses: We use Personal Information to deploy and manage technology applications and systems, manage websites and mobile applications, enable participation in contests and promotions, maintain security, protect against errors and fraud, investigate incidents, manage claims, maintain programs, products and services, and meet legal and regulatory obligations.
D. Communicating With You: We use Personal Information to provide information and updates, respond to inquiries, inform you of public health concerns where applicable, take or verify instructions, send marketing communications with consent, deliver interest-based advertisements, and provide location-based offers or services with consent.
If you no longer wish to receive commercial electronic messages, please follow the unsubscribe directions provided in every commercial electronic message.
E. Conducting Market Research: We may use Personal Information to conduct market research by tracking and analyzing current or previously collected information to improve or develop products, services, programs, promotions, contests or events and to better understand our customer base. We generally use aggregated information or remove direct personal identifiers.
Market research information may include purchase history, website or mobile application activities, account activity, mobile device use, and methods used to apply for or access programs, products, services, promotions, contests or events.
F. Conducting Data Analytics: We may use Personal Information to conduct data analytics or research for business purposes. Wherever possible, we use aggregated, anonymized or de-identified information and minimize the risk of re-identification.
Data analytics may include managing and developing our business, improving programs and services, understanding customer needs and preferences, customizing marketing and measuring marketing effectiveness.
G. Automated Decision-Making: We may use technologies to help provide programs, products and services, manage business operations, communicate with you and enhance customer experience. In most cases, these tools assist but do not replace human judgment.
4. How Do We Share Personal Information?
We may share your Personal Information within the group of companies that Livingoods Limited is a member of or with service providers and other third parties for the purposes described in this policy and in accordance with applicable law. We do not sell your Personal Information to any organization or person, except if we sell or transfer any part of our business.
If you use a program, product or service that involves another person, such as adding household members to your Livingoods Account, we may share your Personal Information with that person as necessary in connection with that program, product or service.
Categories of third parties and service providers with whom we may share Personal Information include software service providers, hosting service providers and data storage service providers.
A. Service Providers: We may share Personal Information with service providers, some of which may be located outside your province or territory of residence or outside Canada. These providers help us operate our business, technology systems, applications, internal procedures, infrastructure, advertising and marketing.
Service providers may provide data hosting, contest administration, email deployment, call centre, marketing, sales and processing or analysis of Personal Information. We require these service providers to limit access and use to what is required to provide their services and comply with our privacy requirements.
The categories of service providers we may disclose Personal Information to include courier and mail service providers, order fulfillment service providers, eCommerce service providers, software service providers, hosting service providers and data storage service providers.
B. Third Parties: In providing programs, products and services, we may do so through arrangements with third parties, some of which may reside outside your province or territory or outside Canada. Your Personal Information may be collected, used and shared by us and the applicable third party, and those third parties may have their own privacy policies and terms.
Examples include sharing Personal Information for identification purposes with a postal service for Livingoods delivery services. Categories of third parties may include insurance brokers and insurers, government entities, sales and marketing tools, and business communication and collaboration tool service providers.
C. Sale Or Transfer Of Business Or Other Transaction: We may sell or transfer all or part of our business, merge with another entity, insure or securitize assets, or engage in a corporate or financing transaction. If Personal Information is required in connection with such transactions, we will comply with legal requirements for disclosure.
D. Other Permitted Reasons: Canadian law permits or requires the use, sharing or disclosure of Personal Information without consent in specific circumstances, such as investigating or preventing illegal activities, fraud, assisting government and law enforcement agencies, or protecting our companies, employees, customers or others.
E. With Your Consent: Other than the purposes listed above, we may, with your implied or express consent, share or disclose your Personal Information outside of our group of companies in accordance with applicable law.
5. How Do We Manage Consent?
By subscribing to our programs, products and services and/or submitting information to us in connection with using our programs, products and services, you consent to the collection, use and disclosure of Personal Information as set out in this policy. In some cases, consent may be "implied" based on your action or inaction at the point of collection, use or sharing.
We will obtain consent when we want to use Personal Information for a new purpose or a purpose other than those stated at the time of collection in this policy or in the terms and conditions of a specific program, product, service, contest, promotion or event. Consent can be withdrawn at any time, except where restricted by legal or regulatory requirements or contractual obligations.
For example, to obtain delivered groceries, you are required to provide consent on your account page to the ongoing collection, use and sharing of Personal Information to allow us to deliver groceries to your chosen address. Your consent for these purposes cannot be withdrawn during the time we provide this service and for a reasonable period afterwards.
If you choose not to provide certain Personal Information or withdraw consent where available, we may not be able to offer the products, services, programs, contests, promotions, events or information that you requested or that could be offered to you.
A. Within Your Account(s): If you have a Livingoods Account, you can update your preferences by signing into your account via the online portal available on the website or mobile application.
B. When You Register Or By Contacting Us Directly: You may opt in to receiving email or SMS marketing communications at registration or thereafter through your online account. You may opt out by clicking unsubscribe in marketing emails, texting STOP within SMS marketing, through your online account, or by contacting us.
Even if you opt out of marketing communications, we may still contact you for transactional purposes in compliance with applicable laws, including customer service, product information, service notices, recalls, order status, shipment or refunds. It may take some time for all records to reflect changes in preferences.
C. Changing Your Browser Settings On Your Device: Technologies such as cookies allow us to recognize when you use or return to our websites. You may delete or disable certain technologies via your browser, but some website features may not work.
D. Using Third Party Unsubscribe Functionality: We may use third parties, such as web companies or social media platforms, that use technologies to analyze browsing behaviour. You can manage privacy preferences with certain third parties, such as Google or Facebook, by using unsubscribe functionality within their platforms.

6. How Do We Protect And Store Personal Information?
We take the security of Personal Information seriously and are committed to protecting privacy through administrative, physical and technical safeguards. These measures include multi-factor authentication, masking, encryption, logging and monitoring. We store Personal Information for as long as necessary to provide programs, products and services and for a reasonable time thereafter, or as permitted or required by law.
A. How We Protect Personal Information: We maintain administrative, technical and physical safeguards in stores, pavilions, kiosks, offices, digital properties and information storage facilities to help avoid loss, misuse, unauthorized access, disclosure or modification of Personal Information. These safeguards also apply when we dispose of or destroy Personal Information.
Examples of safeguards include multi-factor authentication, masking, anonymization, encryption, logging and monitoring.
We maintain policies and practices to protect Personal Information, including internal policies and procedures, designated Privacy Officers, regular employee privacy and security training, and contractual protections and other measures for service providers.
B. Where We Keep Personal Information: We use reasonable safeguards, including contractual requirements with service providers, to protect Personal Information wherever it is used or stored. In general, we store, access and use Personal Information in Canada. Some service providers may access, process or store Personal Information outside your province, territory or Canada when providing services to us.
When a service provider operates outside Canada, Personal Information may be stored, processed, accessed or used in another country and may be subject to the laws of that jurisdiction. The jurisdictions where our service providers are currently located are in Canada.
C. How Long We Keep Personal Information: We store Personal Information for as long as necessary to fulfill the purposes for which it was collected, except where otherwise required or permitted by law. Once no longer required, Personal Information will be securely destroyed or anonymized.
If Personal Information is collected by a third party, it will be retained in accordance with that third party's privacy policies and records retention requirements.
7. How Are Your Rights in Relation to Your Personal Information?
Under Canadian privacy law, you have the right to request access, correction and deletion of the Personal Information we hold about you, subject to legal restrictions. Upon request, we will respond within a reasonable timeframe in compliance with applicable laws.
It is your responsibility to provide accurate, correct and complete information. If you notice errors in your Personal Information or need to update it, please let us know through the steps outlined below.
Some Personal Information we hold about you is accessible through your online account(s). You can access, update or correct your Personal Information by logging into your account(s) and making updates to your profile information and preferences.
For Personal Information not available through your online account(s), you can request access, correction or deletion by contacting our Privacy Office by email or postal address. To access Personal Information collected by a third party, contact that third party directly.
If you are unsatisfied with our response to your access or correction request, or how we handle your Personal Information, please contact our Privacy Office. If the Privacy Office cannot address your concern to your satisfaction, you may bring the matter to the appropriate Privacy Commissioner.
8. How Do I Know If There Are Changes To The Privacy Policy?
We may make changes to this policy from time to time. Any changes become effective when we post a modified version on this webpage. If we make significant changes, we will post a notice on our websites.
By continuing to participate in our programs and/or use our services or purchase our products after the modified version has been posted, you accept the changes, subject to any additional requirements that may apply. If you do not agree, it is your responsibility to stop participating in programs and/or using services or purchasing products.
It is your obligation to ensure that you read, understand and agree to the latest version of the policy. The Effective Date at the top indicates when it was last updated.
9. Who Do I Contact With Privacy Questions?
We have appointed a dedicated Privacy Officer for Livingoods, who is responsible for overseeing our privacy program and ensuring compliance with applicable privacy laws and regulations.

If you have a program, product, service, promotion, contest or event offered by us with a third party, the third party may hold your Personal Information and we will direct you to the appropriate party.
